Private Attorneys General Act Claims
The California Labor Code Private Attorneys General Act of 2004 ("PAGA") authorizes workers to sue employers for Labor Code violations and receive 25% all of civil fines, which in most cases are $200 per violation, per employee, and per pay period, in addition to attorney's fees, costs and all other damages already available (including back wages, interest and penalties). It is imperative that California employers comply with each and every Labor Code requirement. A PAGA lawsuit can cripple, if not close down, a business, even for minor violations.

Before a PAGA lawsuit can be filed, the former or current employee must provide written notice to the employer specifying the Labor Code sections violated. However, the notice to the employer does not need to state the employee's intent to sue. Whenever a letter detailing Labor Code violations is received, Ms. York will assist the employer to immediately take all steps available under the law to avoid, or lessen the impact of, a PAGA lawsuit.
